Privacy Policy
For the MarketCheck AI Desk service.
Effective June 25, 2026
This Privacy Policy explains how Market Check Cars, Inc., a Nevada corporation ("MarketCheck", "we", "us"), handles information when you use MarketCheck AI Desk (the "Service"), whether you reach it through our website at ai.marketcheck.com (also reports.marketcheck.com) or through an AI assistant such as Claude or ChatGPT that connects to our reporting tools. It covers the Service only. It does not cover other MarketCheck products, which have their own policies. Our registered address is 169 Madison Ave STE 57434, New York, NY 10016, and you can reach us about privacy at business@marketcheck.com.
Information we collect
- Account details. When you sign in, we receive your email address and a unique account identifier so we can create your account, associate your credit balance and reports with you, and send transactional email.
- Report inputs. To run a report we process the inputs you provide, such as a vehicle identification number (VIN), ZIP code, mileage, asking or listed price, loss or accident date, and condition. When you use the Service through an AI assistant, the assistant sends these inputs to us on your behalf.
- Dealer brand profile (optional). If you configure a brand profile, we store the business name, address, phone number, website, logo, and brand color you supply so we can brand your reports and window stickers.
- Billing information. Payments are processed by our payment provider, Stripe. We do not store full card numbers. We retain a record of your credit balance, top-ups, the reports you run, and the invoices generated for them.
- Usage and technical data. We log report runs, timestamps, and basic request metadata to operate the Service, prevent abuse, and support you.
How we use information
We use the information above to:
- generate the reports you request and make them available to you, including as shareable hosted links;
- maintain your account, credit balance, and invoice history;
- process payments and send receipts and other transactional messages;
- provide support and respond to your requests;
- monitor for fraud and abuse and keep the Service secure;
- meet legal, tax, and accounting obligations.
We do not sell your personal information, and we do not use your report inputs to train machine learning models beyond what is needed to produce your report.
When you use an AI assistant
If you reach the Service through Claude, ChatGPT, or another AI assistant, that assistant transmits the inputs you give it to our reporting tools and relays our results back to your conversation. Your use of that assistant is governed by the assistant provider's own terms and privacy policy, which we do not control. We receive only the inputs needed to run the report you asked for.
How we use AI
Two parts of the Service use AI models. Both are described here because the output of each appears in reports you may hand to a customer, an adjuster, or a lender.
- Verifying a comparable's advertised price. We fetch the dealer's own listing page and send its text to OpenAI to pull out the sale price excluding documentation and dealer add-on fees. The page is public and the request carries no information about you.
- Assessing a vehicle's condition from photos. When you ask for it, we send a seller's published listing photos through Vercel AI Gateway to Anthropic and Google models, which report the wear and damage visible in them. The photos are the seller's own published images.
We keep a record of each condition assessment, including the photos read and the findings returned, so that a result can be re-checked if it is ever disputed. These requests run through commercial API endpoints, and your data is not used by us or by those providers to train AI models.
AI output is not always accurate. Everything a model produces is shown next to the photo or the page it came from so you can check it yourself, and it is never presented as an inspection or as a statement of fact about a vehicle's condition.
How information is shared
We share information only with service providers that help us operate the Service:
- MarketCheck vehicle data platform, which supplies the active listings, recently delisted listings, and specifications behind each report;
- Stripe, which processes payments;
- Resend, which delivers our transactional email;
- Google Cloud and Firebase, which host the Service;
- Google reCAPTCHA, which protects sign-in and forms from automated abuse;
- Google Analytics, which measures site usage, and only when you allow analytics cookies (see "Cookies, analytics, and tracking" below).
- Vercel AI Gateway, which routes our requests to the AI models described under "How we use AI" below, and through it Anthropic and Google;
- OpenAI, which reads the text of a dealer listing page to pull out the advertised price;
- Bright Data and Firecrawl, which fetch dealer listing pages so a price can be verified and the page captured as evidence.
We may also disclose information if required by law, to enforce our terms, or to protect the rights, safety, and property of MarketCheck, our users, or the public. If our business is involved in a merger or acquisition, information may transfer as part of that transaction.
Cookies, analytics, and tracking
We use a small number of cookies and similar browser storage. We group them into two categories.
Strictly necessary (always on)
- A session cookie that keeps you signed in and secures your account. It is set only after you sign in.
- Local browser storage for functional preferences, such as your light or dark theme and your last sign-in method, and to complete a payment round-trip with Stripe.
- reCAPTCHA: when you sign in or submit a form, Google reCAPTCHA loads to block automated abuse. It is a security measure, loads only at that moment, and may set a Google cookie. We do not use it for advertising.
Analytics (only with your consent)
- Google Analytics 4 measures how the site is used so we can improve it. It does not load and sets no analytics cookies until you allow analytics on the cookie banner.
- First-touch campaign attribution (which link brought you here) and, on our window-sticker scan pages, a per-visitor identifier used to count unique scanners. These are stored only when you allow analytics.
On your first visit we ask for your choice on a cookie banner, and nothing in the analytics category loads until you accept. You can change your choice at any time using the "Your Privacy Choices" link in the footer, and we honor the Global Privacy Control (GPC) browser signal as an opt-out. Because we do not load analytics or advertising cookies without consent, we do not sell or share your personal information for cross-context behavioral advertising. We also self-host our fonts, so loading a page does not send your details to a third-party font provider. For the full list of cookies, durations, and providers, see our Cookie Policy.
Data retention
We keep your account details, invoices, and the reports you generate for as long as your account is active and as needed to provide the Service, so you can retrieve past reports and billing records. We retain billing records for the period required by tax and accounting law. You can ask us to delete your account and associated data, and we will do so except where we are required to keep certain records.
Security
All traffic to and from the Service is encrypted in transit using HTTPS/TLS. We restrict access to stored data to the systems and personnel that need it to operate the Service. No method of transmission or storage is perfectly secure, so we cannot guarantee absolute security.
Your choices and rights
You can access and update your account information, payment method, and brand profile in your account area, and change your cookie choices any time using the "Your Privacy Choices" link in the footer. To exercise any of the rights below, email business@marketcheck.com. We will not discriminate against you for exercising your rights, and we verify requests against your account before acting on them.
California residents (CCPA/CPRA)
If you are a California resident, you have the right to:
- know what personal information we collect, use, and disclose, and request access to it;
- request deletion or correction of your personal information;
- opt out of the "sale" or "sharing" of personal information for cross-context behavioral advertising;
- limit the use of sensitive personal information;
- not receive discriminatory treatment for exercising these rights.
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We honor opt-out preference signals: if your browser sends the Global Privacy Control (GPC) signal, we treat it as a valid request to opt out of analytics and we do not load non-essential cookies for that visit.
UK and EU residents (UK GDPR / EU GDPR)
If you are in the UK or EU, you have the right to access, rectify, erase, restrict, or port your personal data, to object to certain processing, and to withdraw consent at any time (which does not affect processing already carried out). Our legal bases are: performing our contract with you (providing the Service), our legitimate interests (securing and improving the Service), your consent (for analytics cookies), and compliance with legal obligations (such as tax records). You may also lodge a complaint with your local supervisory authority, such as the UK Information Commissioner's Office.
Children
The Service is intended for business and adult consumer use and is not directed to anyone under 18. We do not knowingly collect information from children.
Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will revise the effective date above and, for material changes, provide a more prominent notice. Continued use of the Service after an update means you accept the revised policy.
