Acceptable Use Policy
For the MarketCheck AI Desk service.
v1 · Last updated August 21, 2026
1. Introduction and scope
This Acceptable Use Policy (the "Policy") governs your use of MarketCheck AI Desk (the "Service"), provided by Market Check Cars, Inc., a Nevada corporation ("MarketCheck", "we", "us").
It supplements our Terms of Service (the "Terms") and expands on Section 4 of the Terms. If this Policy and the Terms conflict, the Terms control. Terms defined in the Terms have the same meaning here.
You must comply with this Policy whenever you use the Service, whether through our website or through a connected AI assistant. Violations may result in throttling, suspension, or termination of your access under Section 10 of the Terms.
2. Fair use of credits and reports
Reports are priced individually and drawn against your credit balance. Every run that completes is charged, whether you started it from the website or an assistant started it for you.
- Do not attempt to obtain reports without paying for them, including by circumventing billing, replaying a paid result, or manipulating a report link to produce a further report.
- Do not create multiple accounts to repeat promotional credits, trial allowances, or introductory pricing.
- Do not share a report link, an account, or account credentials in order to resell access to the Service. A report link is a bearer link: anyone holding it can open the report, so treat it as you would the document itself.
- Reports are licensed for your own business or personal use under Section 7 of the Terms. Do not resell, redistribute, or sublicense report data in bulk, and do not scrape or systematically extract the underlying data.
3. Using the Service through an AI assistant
When you connect the Service to an assistant, that assistant can spend your credit balance on your behalf. You remain responsible for what it spends.
- You are responsible for every report run initiated under your account, including runs an assistant or an automated agent starts without a further prompt from you.
- Do not put the Service inside an unattended loop, batch job, or agent that can run reports repeatedly without a person reviewing what is being spent.
- Keep a payment ceiling you are comfortable with. If you enable automatic top-ups, set them to an amount you would accept losing to a misbehaving script.
- Your use of the assistant itself is governed by that provider's terms, which we do not control.
4. What a report is, and what it is not
This section restates Section 5 of the Terms because it is the provision most often stretched in practice.
- Reports are estimates built from market data, statistical models, and, where a report says so, an AI reading of published listing photographs. They are not inspections, and nobody has seen the vehicle.
- A condition assessment reports what is visible in a seller's listing photographs. It is not a representation that a vehicle is free of damage, and it must not be presented as one.
- Do not present a report as a licensed appraisal, a certified valuation, or an inspection report, and do not attach a professional's name or licence number to a report they did not review.
- Where a decision requires a licensed professional, such as a total-loss settlement or a formal appraisal, that professional must be involved and must exercise their own judgement. Do not use a report as the sole basis for such a decision.
- Do not remove or obscure the notices on a report that identify AI-generated content, the data sources, or the date the underlying listings were captured.
5. Personal data you give us
Some reports let you record the details of the person whose vehicle is being valued, such as a name, address, and telephone number, so the finished document reads as a working file. When you do that, you decide what is collected and why, and we process it for you under our Data Processing Agreement.
- Only enter personal data you are entitled to share with us, and only what the document actually needs.
- Do not enter special category data, such as health information, or government identifiers such as a social security number. The Service has no field that needs them.
- Before you send a report link to someone, remember it carries whatever you entered.
6. Prohibited conduct
In addition to the restrictions in the Terms, the following is prohibited:
- Using the Service in a way that degrades performance or availability for other customers.
- Sending requests at a rate or volume designed to stress-test or benchmark the Service without our prior written agreement.
- Submitting malicious, malformed, or intentionally oversized inputs.
- Attempting to reach reports, accounts, data, or systems your account does not authorise, including by guessing or enumerating report links.
- Using automated tools to create accounts or bypass sign-up steps.
- Misrepresenting your identity, business, or intended use when signing up or when corresponding with us.
- Using the Service, or output from it, to train a machine-learning model, or to build or improve a competing product.
- Using the Service for any unlawful purpose or in violation of any applicable law or third-party right.
7. Security research
If you find a security vulnerability, report it promptly to security@marketcheck.com. Do not exploit it, disclose it publicly, or demonstrate it before we have had a reasonable opportunity to investigate and fix it.
Get our written authorisation before any penetration testing, vulnerability scanning, or load testing against the live Service. Unauthorised testing is a violation of this Policy and may result in immediate termination.
Include a clear description of the issue, the steps to reproduce it, and the impact you have identified. Researchers who follow this section and report in good faith will not face account action for the research itself.
8. Monitoring and enforcement
We monitor report runs, spending patterns, and account activity to detect conduct inconsistent with this Policy or the Terms. Where we identify a possible violation we may, at our discretion:
- issue a written warning describing the concern and asking for corrective action;
- throttle or limit your access to particular reports or tools;
- suspend your account while we investigate; or
- terminate your access under Section 10 of the Terms.
We are not required to give advance notice, though where it is practical we will tell you what the concern is and what we have done. We may choose among these actions in any order based on the severity, frequency, or impact of the violation. Repeated or severe violations may result in permanent termination and a refusal of future sign-ups.
Suspension or termination for a violation does not entitle you to a refund of an unused credit balance, except where the law requires one.
9. Reporting violations
If you believe another user is violating this Policy or the Terms, write to abuse@marketcheck.com. So we can investigate, include what you can: the account, business, or report involved; what you believe breaches this Policy and which section; and any supporting evidence such as screenshots, links, or timestamps.
We review every report made in good faith. Submitting one does not oblige us to take any particular action or to tell you the outcome. Do not submit reports that are frivolous, retaliatory, or that you know to be false; abusing the reporting process is itself a violation.
10. Changes to this Policy
We may update this Policy. For material changes we will post the revised version here with a new "last updated" date and email account holders at their account address. Minor corrections and clarifications will be reflected in the date alone.
Continuing to use the Service after a change takes effect means you accept the revised Policy. If you do not agree, stop using the Service and close your account before it takes effect.
