FTC price guidance lands as 9.09% of used car listings show no advertised price
6,365,355 active US dealer listings now sit under a federal advertised-price standard.

The FTC has published staff guidance, in the form of FAQs, on price transparency in vehicle advertising, and bbrown.com reported on it on Oct 09, 2026. This is a US market story: the guidance says an advertised vehicle price must reflect what any consumer can pay, excluding only government-mandated charges such as taxes, title and registration, and it applies across dealer websites, third-party listings, social media and print. MarketCheck live inventory data counts 6,365,355 active listings on US dealer websites on Oct 12, 2026, which is the practical scope of the standard. Against that backdrop, 9.09% of active used listings carry no advertised price at all, compared with 2.21% of new listings. The guidance itself is not new this month: the FTC published the FAQs on Sep 15, 2026. What changed in October is enforcement. On Oct 08, 2026 the FTC settled with Greenway Auto Group, where the FTC alleged the group charged an average of more than $3,350 above the advertised price in over 92% of transactions.
What the data shows
| Measure | Used, Oct 12, 2026 | New, Oct 12, 2026 |
|---|---|---|
| Active listings (count) | 3,040,740 | 3,324,615 |
| Listings with no advertised price (count) | 276,453 | 73,542 |
| Share with no advertised price (%) | 9.09% | 2.21% |
| Median asking price ($) | $24,520 | $48,783 |
| 90th percentile asking price ($) | $49,329 | $79,817 |
| Median days on market (days) | 119 | 51 |
Used listings are four times as likely as new ones to carry no advertised price, and they stay listed for a median 119 days against 51, so an outdated or fee-exclusive price can sit in front of buyers for months. All figures here are advertised asking prices, not transaction prices.
By dealer type, the same Oct 12, 2026 snapshot splits as follows: franchise dealers hold 4,891,159 active listings, or 76.8%, independents hold 1,473,838, or 23.2%, and all US dealers together hold 6,365,355, or 100%. Franchise dealers advertise more than three of every four vehicles for sale online, so most of the guidance's practical impact falls on their pricing pages and syndicated feeds.
Why it matters
The scope is the whole lot. The FAQs cover dealer websites, third-party listings, social media and print. With 6,365,355 active listings on US dealer websites on Oct 12, 2026, dealers and marketplaces carry the same advertised-price obligation on the same inventory.
Franchise groups hold most of the exposure. At 76.8% of active US listings, franchise rooftops account for the bulk of advertised prices in market.
Unpriced used cars are a sizeable share. 276,453 used listings, or 9.09%, show no advertised price, against 73,542 new listings, or 2.21%. Buyers comparing used cars online cannot see a price on roughly one in eleven listings, and the FAQs govern the prices that are shown.
Enforcement now has a dollar figure attached. The Greenway settlement on Oct 08, 2026 followed the FTC's allegation of charges averaging more than $3,350 above the advertised price in over 92% of transactions.
State rules stack on the federal guidance. California's CARS Act took effect Oct 01, 2026 and requires a total price that includes dealer fees, according to MarketCheck research. Groups operating in several states now have both a federal and a state reason to fold fees into the advertised number.
There is a measurement consequence worth flagging. The median advertised used price today is $24,520. As dealers fold document and prep fees into that number, advertised prices will rise mechanically. A rise in advertised asking prices this autumn will therefore partly reflect a change in disclosure rather than a change in demand.
What to watch
- Advertised used and new median asking prices in the Oct and Nov 2026 data. A step-up of fee size, without a matching change in days on market, points to fee inclusion rather than stronger demand.
- The share of used listings with no advertised price, now 9.09%. If it rises, buyers and marketplaces face less comparable pricing just as the guidance is meant to increase it.
- Further settlements among the 97 dealership groups the FTC warned in Mar 2026. Audits should cover syndicated and third-party listings, not only a dealer's own website.
- Final contract prices against advertised prices. Persistent gaps above government charges match the pattern the FTC alleged at Greenway.
How this was measured
All figures are active listings on US dealer websites on Oct 12, 2026, by advertised asking price, not transaction price. "No advertised price" means the listing carried no price. Days on market measures cars still for sale, not days to sell. The same car can appear on more than one site. Shares are counts divided by the reported totals. No sold-vehicle comparison was pulled for this piece.
